Terms of use
Last updated:
These terms are the agreement between you and Unabated Games Ltd (company 08502769, registered in England and Wales), which runs Unabated Games Arcade. "We" and "us" mean us; "you" means you. By making an account, buying anything or posting anything, you agree to them. Our privacy notice says what we do with your information.
1. Who can use the arcade
- Anyone can play free games without an account. To make an account you must be 13 or older.
- If you're under 18, read these terms with a parent or guardian. Buying coins and the Arcade Pass is for players 18 and over, and so is anyone who hasn't told us their date of birth yet. You can still spend coins you're given and redeem gift cards.
- One account per person. Give us your real email address and keep your password to yourself. You're responsible for what happens on your account; tell us straight away if someone else gets into it.
2. Games
- Games on the arcade are made by us and by other studios. When you get a game, free or paid, you get a personal licence to play it on the arcade. You don't own the game itself.
- Studios update their games, and a game may change or, rarely, be withdrawn. If a game you paid for is withdrawn, we'll keep it playable or offer you a fair remedy.
- Some progress is saved only in your browser. Sign in to keep it with your account (see cookies).
- Play fair. Don't cheat, use bots, or tamper with games, scores or the arcade. We remove scores that can't be real, and the arcade rejects some automatically (see section 6).
3. Coins, Sparks and the Arcade Pass
Coins are the arcade's currency. You can buy them, get them with the Arcade Pass, receive them as a gift or gift card, or be given them in a promotion. You spend them on games, add-ons and items in games. Sparks are earned by playing and can't be bought; there'll be things to spend them on soon.
- Coins and Sparks are a licence to use the arcade's features, not money. They have no cash value, and you can't exchange them for money or sell or transfer them, except through the arcade's own gifting.
- Coins don't expire while your account is open. When an account is closed, for any reason, any coins and Sparks left in it are lost and aren't refunded.
- The price you see at checkout is the price you pay. Payments are handled by Stripe.
Your right to cancel
Normally you could cancel an online purchase within 14 days. Coins (and the coins in each Arcade Pass month) are delivered to your wallet straight away. Before you pay, we ask you to agree to that, and to confirm you understand that you lose the right to cancel once they're delivered. So purchases are final and we don't refund them, except as below.
This doesn't affect your legal rights. If something you bought is faulty or isn't as described (for example, coins you paid for never arrive, or a paid game doesn't work), contact us and we'll put it right: fix it, replace it, or refund you. If a game we supply damages your device because we didn't take reasonable care, we'll repair the damage or compensate you.
The Arcade Pass
- The Arcade Pass is a monthly subscription. It adds coins to your wallet at the start of each month, and renews automatically each month until you cancel.
- Cancel any time on your wallet page. The Pass then stops at the end of the month you've paid for, and you keep the coins it has given you. We don't refund part months.
- If we change the price or the coins it includes, we'll tell you at least 30 days before your next payment, so you can cancel first.
If you dispute a payment with your bank when you've had what you paid for, we may take back the coins or items and pause your account while it's sorted out.
4. Groups, chat and what you post
You own what you post: messages, pictures, your profile, groups you make. You give us a worldwide, royalty-free licence to store, copy and show it to the people you shared it with, for as long as it's on the arcade, so the arcade can work. Only post things you have the right to share.
Don't post or send anything that:
- sexualises children, or tries to groom or exploit them. We report this to the National Crime Agency and close the account;
- supports terrorism or violent extremism;
- is illegal anywhere we operate, or encourages crime;
- is pornographic, or promotes suicide, self-harm or eating disorders. These aren't allowed for anyone, of any age;
- bullies, harasses, threatens or stirs up hatred against anyone, including for their race, religion, sex, sexuality, gender identity or disability;
- shares someone else's private information, or intimate images of anyone;
- pretends to be someone else, or is spam, a scam or malware;
- infringes someone's copyright or trade mark.
Be careful who you talk to. Never share your password, address or phone number in chat, and tell us about anyone who makes you uncomfortable.
5. Reporting a problem
Anyone can report content or an account, with or without an account. Use the Report button on any message, player, group, game or studio, or the report form, which needs no account and lets you stay anonymous. You can also email [email protected]. We'll confirm we've received it and tell you what we decided, in your inbox or by email. You can also complain to us about how we handled a report, about action we took against your content or account, or that we've wrongly judged your age.
6. How we moderate
- A person on our team looks at every report. We act faster on the most serious harms, and straight away on child sexual abuse and terrorism.
- We may remove content, remove scores, limit what an account can do, suspend it, or close it. We'll tell you what we did and why, which part of these terms it was under, and how to appeal, unless the law or the police ask us not to.
- Appeals: reply to our message or email us within six months. Someone who wasn't involved in the first decision will look again, and if we got it wrong we'll undo it.
- Automatic tools. We tell you about every one we use. Today they are: the GIF search only shows GIFs GIPHY rates suitable for teens; link previews in chat only show pictures from a short list of well-known sites; and the arcade rejects scores outside a game's limits. We don't scan your messages. If that changes, we'll update these terms first.
- We report content that suggests a child is in danger to the National Crime Agency, and act on lawful requests from the police and other authorities.
7. Studios
- Only publish games and material you have the rights to publish.
- You give us a non-exclusive, worldwide licence to host, distribute, show and promote your games, listings and assets on the arcade, and to sell them to players.
- Your games and listings must follow section 4. We can remove a game or listing that breaks the law or these terms.
- Revenue share and payouts are set out in the developer portal. Separate developer terms are coming; until then, these terms apply.
8. Closing an account
- You can close your account any time by emailing us.
- We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Except for the most serious cases, we'll warn you first.
- If we ever close the arcade, we'll give you at least 30 days' notice. Remember that coins left in a closed account are lost (section 3).
9. Our responsibility to you
- We're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or not taking reasonable care. We're not responsible for losses nobody could have foreseen.
- The arcade is for personal use. We're not responsible for business losses, such as lost profits.
- We work to keep the arcade running and your data safe, but we can't promise it will never be interrupted.
- Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit, and nothing takes away your legal rights as a consumer.
10. Changes
We'll update these terms as the arcade changes. For anything important, we'll email you at least 30 days before the change takes effect. If you don't agree, you can close your account before then.
11. The law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you can bring a claim in your own courts, and if you live in the EU you keep the protections your own country's law gives you.
